2. KVM VPS

VPS Service Agreement · AP Interactive Solutions S.L · Version 1.0 · March 2026

By ordering a Virtual Private Server ("the Service") from AP Interactive Solutions S.L, the customer ("the Client") accepts these terms, governed by Spanish law and applicable EU regulations.

1. Fair Use & Network Policy

All VPS plans include a specified monthly bandwidth allowance. Network usage is subject to a fair use policy. The Client must ensure that their usage patterns are consistent with standard hosting, application, and development workloads.

Excessive or sustained use of network resources that degrades service quality for other customers may result in temporary bandwidth restrictions or additional charges after prior notification.

2. Bandwidth Limits & Throttling

Each plan includes a specific monthly bandwidth allowance (or unlimited, subject to fair use). Once the monthly bandwidth limit is reached, the VPS connection will be throttled to 50 Mbps for the remainder of the billing cycle. The Client may request additional bandwidth at an extra cost by contacting support.

"Unlimited bandwidth" plans are subject to fair use and are designed for standard server workloads. AP Interactive Solutions S.L reserves the right to apply restrictions if usage significantly exceeds reasonable levels for the plan tier.

3. DDoS Protection & Abuse

All VPS plans include DDoS protection as specified for each location. However, the Client shall not:

  • Use the Service as a "dstat" target, traffic sink, or any tool designed to attract or relay DDoS attacks
  • Intentionally or negligently attract volumetric attacks to the infrastructure
  • Share the VPS IP or connectivity for the purpose of receiving attacks on behalf of third parties
  • Run open resolvers, amplification vectors, or any service that facilitates reflection attacks

If a VPS is the target of frequent or recurring DDoS attacks, AP Interactive Solutions S.L may, at its sole discretion:

  • Temporarily null-route the affected IP address
  • Apply additional charges based on the bandwidth consumed by the attack mitigation
  • Require the Client to upgrade to a plan with enhanced mitigation capabilities
  • Suspend or terminate the Service if attacks persist and the Client takes no reasonable action to prevent them

4. Prohibited Activities

The Client shall not use the Service for:

  • Sending spam, phishing emails, or bulk unsolicited communications
  • Hosting malware, botnets, command-and-control servers, or exploit kits
  • Port scanning, network probing, or attacking third-party systems
  • Cryptocurrency mining (unless explicitly authorized in writing)
  • Hosting content that violates applicable Spanish or EU law (including GDPR)
  • Infringing intellectual property rights (DMCA / EU Copyright Directive)
  • Running TOR exit nodes without prior written approval
  • Any activity that could result in IP addresses being blacklisted (Spamhaus, SORBS, etc.)

5. Resource Usage

VPS resources (CPU, RAM, disk, IOPS) are allocated as specified in the plan. The Client shall not attempt to exceed the allocated resources through exploits or abuse. Sustained 100% CPU usage that impacts other tenants on shared infrastructure may be subject to throttling after notification.

6. Data & Backups

The Client is solely responsible for maintaining backups of all data stored on the VPS. AP Interactive Solutions S.L does not guarantee data recovery in the event of hardware failure, accidental deletion, or any other cause of data loss. The Client is strongly advised to maintain off-site backups.

7. Suspension & Termination

AP Interactive Solutions S.L reserves the right to suspend the Service immediately and without prior notice in the event of:

  • Violation of any of these terms
  • Non-payment of invoices after the due date
  • Receipt of valid abuse complaints or law enforcement requests
  • Recurring DDoS attacks that jeopardize infrastructure stability

Data on suspended VPS instances is retained for 7 days after suspension. After this period, data may be permanently deleted without further notice.

8. Liability

AP Interactive Solutions S.L provides the Service on an "as-is" basis and does not guarantee 100% uptime. The Client acknowledges that occasional downtime for maintenance or unforeseen events may occur. AP Interactive Solutions S.L shall not be liable for any indirect, consequential, or incidental damages arising from service interruptions.

9. Governing Law

This agreement is governed by Spanish law. Any dispute shall be submitted to the courts of Malaga, Spain.

Last updated: March 2026 · Version 1.0

3. Web Hosting (Plesk)

Web Hosting Service Agreement · AP Interactive Solutions S.L · Version 1.0 · April 2026

By ordering a Web Hosting plan ("the Service") from AP Interactive Solutions S.L, the customer ("the Client") accepts these terms, governed by Spanish law and applicable EU regulations. The Service is delivered on shared Plesk-managed infrastructure located in Madrid, Spain.

1. Service Scope

The Service provides shared web hosting with the resources specified in the selected plan (number of sites, disk storage, email accounts, databases, monthly bandwidth). Each plan runs on a multi-tenant server alongside other customers. AP Interactive Solutions S.L manages the underlying operating system, web server, database engine, and Plesk control panel.

2. Fair Use & Shared Environment

All shared hosting resources (CPU, RAM, entry processes, I/O) are subject to a fair use policy. Sustained or abusive use that degrades service for other tenants may trigger temporary throttling, forced process limits, or, after notification, a required upgrade to a dedicated plan (VPS or dedicated server).

The Client is expected to keep applications reasonably optimised. Long-running cron jobs, high-frequency polling loops, unbounded queries, and similar patterns that saturate a shared server are not compatible with this plan tier.

3. Acceptable Use

The Client shall not use the Service to:

  • Send unsolicited email, marketing blasts, or phishing
  • Host malware, exploit kits, web shells, or command-and-control endpoints
  • Relay traffic or act as a proxy/VPN exit for third parties
  • Run cryptocurrency miners or similar sustained-compute workloads
  • Host file sharing, warez, or any content that infringes intellectual property
  • Host child sexual abuse material (CSAM) or any content illegal under Spanish or EU law
  • Scan, probe, or attack third-party systems from the shared infrastructure
  • Run IRC networks, anonymous remailers, TOR exit nodes, or open relays

4. Email Sending

Outbound email from shared hosting is subject to rate limits aligned with industry standards to protect server IP reputation. AP Interactive Solutions S.L may enforce per-domain sending quotas, require SPF/DKIM alignment, and temporarily block outbound mail if spam reports or blacklist listings are detected. For transactional volume beyond these limits, a dedicated SMTP relay or upgraded plan is recommended.

5. Backups & Data Responsibility

AP Interactive Solutions S.L may perform server-wide backups for infrastructure recovery purposes but does not guarantee per-site restoration. The Client remains solely responsible for maintaining independent backups of their content, databases, configuration, and email. We strongly advise using Plesk's built-in backup tool and downloading copies to a separate location.

6. DNS, Domains & TLS

The Client is responsible for pointing their domain's authoritative nameservers to the records provided by AP Interactive Solutions S.L (typically ns1.hostealo.eu and ns2.hostealo.eu), or for configuring the relevant A/AAAA/MX records if external DNS is used. Free Let's Encrypt TLS certificates are auto-provisioned where the DNS setup permits; third-party certificates may be uploaded through Plesk.

7. Software, Apps & Customer Responsibility

One-click installers (WordPress, Joomla, etc.) and any third-party application installed by the Client are provided on an as-available basis. AP Interactive Solutions S.L does not audit, patch, or support the application code itself. The Client is responsible for keeping CMS cores, themes, plugins, and custom code up to date. Outdated installations that get compromised and abused will be suspended until remediated.

8. Uptime & Maintenance

The Service is provided on a best-effort basis with a target monthly uptime of 99.9%. Scheduled maintenance will, whenever possible, be announced in advance through the panel and/or email. AP Interactive Solutions S.L may perform emergency maintenance without prior notice when required to preserve security or service availability.

9. Suspension & Termination

AP Interactive Solutions S.L reserves the right to suspend the Service immediately and without prior notice in the event of:

  • Violation of any of these terms or the general Acceptable Use Policy
  • Non-payment of invoices after the due date
  • Valid abuse complaints, DMCA/EU takedown requests, or law enforcement orders
  • Compromise of the Client's account (malware, unauthorised access) that threatens other tenants

Suspended hosting accounts are retained for 7 days for remediation. After this period, data (files, databases, email) may be permanently deleted without further notice.

10. Liability

AP Interactive Solutions S.L provides the Service on an "as-is" basis and does not guarantee absolute uptime, perfect data integrity, or fitness for any particular purpose. AP Interactive Solutions S.L shall not be liable for indirect, consequential, or incidental damages, including lost revenue, lost data, or third-party claims arising from service interruptions.

11. Governing Law

This agreement is governed by Spanish law. Any dispute shall be submitted to the courts of Madrid, Spain, without prejudice to mandatory consumer-protection rights that may apply to the Client under EU law.

4. Dedicated servers

6. Domains

Domain Registration & Transfer Agreement · AP Interactive Solutions S.L · Version 1.0 · April 2026

By registering, transferring or renewing a domain name ("the Domain") through AP Interactive Solutions S.L, the customer ("the Registrant") accepts these terms in addition to the policies of ICANN and the applicable registry for each TLD. AP Interactive Solutions S.L acts as a reseller of accredited registrars and is not a registry operator.

1. Registry & ICANN Policies

Every domain is subject to the policies of the corresponding registry and, for generic TLDs, to ICANN's Registrar Accreditation Agreement (RAA) and the Uniform Domain-Name Dispute-Resolution Policy (UDRP). Country-code TLDs (ccTLDs) are additionally subject to their national regulations: in particular, .es domains fall under the rules published by Red.es. The Registrant acknowledges that these external policies may override any service commitment made by AP Interactive Solutions S.L.

2. Accurate Registration Data

The Registrant must provide true, current, and complete contact information (WHOIS/RDAP data) and keep it updated throughout the life of the Domain. Deliberately false or outdated data is grounds for suspension or cancellation of the Domain by the registry, without refund. Some ccTLDs (including .es) require additional verification such as a national ID number; failure to provide it may delay registration or trigger a "pending validation" status until the registry confirms eligibility.

3. Pricing & Renewals

Domain prices shown on AP Interactive Solutions S.L include a commercial margin over the wholesale registry cost. Prices may be adjusted at any time to reflect changes imposed by registries. Renewal is charged at the sell price in effect at the renewal date.

Domains do not renew automatically unless the Registrant explicitly enables auto-renewal. Failure to renew before the expiry date may result in the Domain entering a grace period, a redemption period with registry-imposed recovery fees, and finally deletion. AP Interactive Solutions S.L is not liable for domains lost due to missed renewal.

4. Transfers & Authorisation Codes

Inbound transfers require a valid authorisation (EPP/AuthCode) and admin/registrant email access. Outbound transfers follow the same process: the Registrant may request the AuthCode for any Domain they own through support. Per ICANN policy, newly registered or recently transferred domains are locked for 60 days before a further transfer is permitted. Certain ccTLDs apply their own transfer rules.

5. Nameservers & DNS

By default, domains registered or transferred through AP Interactive Solutions S.L are configured with the nameservers ns1.hostealo.eu and ns2.hostealo.eu. The Registrant may update the nameservers at any time through the client panel. Using external nameservers does not affect the validity of the registration.

6. Cancellation & Refunds

Domain registrations and renewals are non-refundable once the transaction has been forwarded to the registry, including in cases where the Registrant no longer wishes to use the Domain. This follows the distance-selling exemption under Spanish law for digital content whose execution has begun with the Registrant's express consent (Art. 103.m, Royal Legislative Decree 1/2007). In exceptional cases where the registry refuses the order and reverses the fee, AP Interactive Solutions S.L will issue a credit to the Registrant's account balance.

7. Trademark & Intellectual Property

The Registrant represents that registering the Domain does not infringe any third-party trademark, trade name, or other intellectual property right. Domains may be subject to Trademark Clearinghouse (TMCH) checks and sunrise policies for new TLDs. Disputes over a registered Domain are resolved through UDRP (gTLDs) or the corresponding ccTLD dispute mechanism (for .es, the Red.es resolution procedure).

8. Prohibited Use

The Domain shall not be used to:

  • Engage in phishing, impersonation, or fraud schemes
  • Distribute malware, unauthorised software, or exploit content
  • Host or link to content illegal under Spanish or EU law, including CSAM
  • Impersonate public institutions, payment providers, or banking entities
  • Support spam, pharming, or DNS-based abuse campaigns

Upon a credible abuse complaint or registry / law-enforcement notice, AP Interactive Solutions S.L may suspend the Domain, modify its DNS, or initiate deletion as required by the competent authority.

9. WHOIS & Privacy

Personal data submitted during registration is processed by AP Interactive Solutions S.L and forwarded to the corresponding registry and registrar as required to operate the Domain, in accordance with ICANN policy, the relevant registry agreements, and the EU General Data Protection Regulation (GDPR). For gTLDs, non-personal Registrant data is published in RDAP; personal data is redacted in line with the ICANN Registration Data Policy.

10. Liability

AP Interactive Solutions S.L acts as an intermediary between the Registrant and the registry. We are not responsible for registry-side failures, registry policy changes, ccTLD verification delays, or losses caused by domain expiry due to missed renewal reminders. The Registrant agrees to indemnify AP Interactive Solutions S.L against any third-party claim arising from the Domain's registration or use.

11. Governing Law

This agreement is governed by Spanish law and the policies of ICANN and the applicable registry. Any dispute shall be submitted to the courts of Madrid, Spain, without prejudice to mandatory consumer-protection rights that may apply to the Registrant under EU law.

Last updated: April 2026 · Version 1.0

7. Colocation

Colocation Service Agreement · AP Interactive Solutions S.L · Version 1.0 · March 2026

By ordering colocation services ("the Service") from AP Interactive Solutions S.L, the customer ("the Client") accepts these terms, governed by Spanish law and applicable EU regulations.

1. Service Scope

The Service provides physical rack space (measured in rack units, "U") in the designated datacenter facility. It includes access to the shared power infrastructure at the wattage specified in the selected plan, shared network uplink, and physical security. The Client retains ownership and responsibility for all equipment housed in the allocated space.

2. Equipment & Access

The Client must ensure that all hardware is properly rack-mountable, does not exceed the allocated space, and complies with applicable electrical safety standards (CE marking required for EU facilities). Physical access to the facility is subject to the datacenter's access policy, which may require advance scheduling, ID verification, and escort procedures. Remote-hands support is available upon request and may incur additional charges.

3. Power & Network

The power allocation specified in the plan is a maximum continuous draw. Exceeding this limit may result in additional charges or service adjustment. Network uplink is shared unless a dedicated port is contracted. AP Interactive Solutions S.L does not guarantee specific bandwidth throughput on shared links. The Client is solely responsible for the content and legality of all network traffic.

4. Prohibited Activities

The Client shall not:

  • House equipment that poses fire, electrical, or environmental hazard
  • Store hazardous, flammable, or explosive materials
  • Exceed the contracted power or space allocation without prior authorization
  • Use the Service for any activity prohibited by applicable law
  • Modify or tamper with datacenter infrastructure, cabling, or power systems
  • Grant facility access to unauthorized third parties

5. Liability & Insurance

AP Interactive Solutions S.L shall not be liable for damage to, theft of, or loss of the Client's equipment except in cases of proven gross negligence. The Client is strongly advised to maintain appropriate insurance for all colocated hardware. AP Interactive Solutions S.L provides standard facility security (CCTV, access control) but does not act as an insurer.

6. Termination & Equipment Removal

Either party may terminate with 30 days written notice. Upon termination, the Client must remove all equipment within 14 days. Equipment not retrieved within 30 days of service end will be considered abandoned and may be disposed of at the Client's expense.

7. Governing Law

This agreement is governed by Spanish law. Any dispute shall be submitted to the courts of Malaga, Spain. For facilities located in Germany, local German regulations regarding electrical safety (VDE), fire protection, and data protection (BDSG/GDPR) additionally apply.

Last updated: March 2026 · Version 1.0

8. IP Block /24

Acceptable Use Policy · /24 IPv4 Block · AP Interactive Solutions S.L · Version 1.0 · March 2026

By requesting the lease of an IPv4 /24 address block ("the Service") from AP Interactive Solutions S.L, the customer ("the User") expressly and irrevocably accepts these terms, which are governed by Spanish law and applicable European Union regulations.

1. Lawful and Responsible Use

The User shall use the IP block exclusively for lawful purposes. Any use that violates Spanish, European, or international law is strictly prohibited, including but not limited to:

  • Sending unsolicited commercial email (spam) or phishing campaigns
  • Hosting, distributing, or facilitating access to malware, botnets, or C2 infrastructure
  • Conducting port scanning, brute-force attacks, or any form of network intrusion
  • Hosting child sexual abuse material (CSAM) or any content illegal under EU law
  • Operating open resolvers or services that facilitate DNS/NTP amplification attacks

2. IP Reputation and Blacklists

The User is solely responsible for maintaining the reputation of the assigned IP addresses. If any IP in the block is listed on major blacklists (Spamhaus, SORBS, Barracuda, etc.), AP Interactive Solutions S.L may request remediation within 48 hours. Failure to delist may result in null-routing the affected range.

3. Suspension and Null-Routing

AP Interactive Solutions S.L reserves the right to suspend the Service immediately and without prior notice, including null-routing the entire /24 block, in the event of:

  • Confirmed abuse originating from the block
  • Receipt of a valid law enforcement or judicial request
  • Persistent blacklisting that affects shared infrastructure reputation
  • DDoS attacks targeting or originating from the assigned block

4. Liability and Indemnification

AP Interactive Solutions S.L acts solely as a transit and BGP announcement provider and assumes no liability for traffic routed through the assigned block. The User agrees to indemnify and hold harmless AP Interactive Solutions S.L from any claim, damage, or expense arising from the User's use of the IP block.

5. Cooperation with Authorities

AP Interactive Solutions S.L will fully cooperate with any lawfully issued judicial or law enforcement request related to the assigned IP block. This includes, but is not limited to, providing subscriber information, traffic metadata, and assignment records as required by Spanish law (Ley Orgánica 10/1995, Ley 34/2002 LSSI-CE) and EU regulation (GDPR, Directive 2006/24/EC as applicable).

6. Compliance with RIPE NCC Policies

The assigned block is subject to RIPE NCC policies. The User must maintain accurate RIPE database objects (inetnum, route, aut-num) and respond promptly to any inquiry from RIPE NCC or AP Interactive Solutions S.L regarding resource usage.

7. Breach and Termination

Breach of any of these terms entitles AP Interactive Solutions S.L to suspend or terminate the contract immediately. Upon termination, the BGP announcement will be withdrawn and the IP block reclaimed. No refund will be issued for the remaining billing period in case of termination for cause.

8. Governing Law and Jurisdiction

This agreement is governed exclusively by Spanish law. The parties submit to the exclusive jurisdiction of the courts of Malaga, Spain, for any dispute arising from or related to this agreement. The User acknowledges that this agreement is also subject to any mandatory consumer protection laws that may apply to them.

Cookie Policy · AP Interactive Solutions S.L · Version 1.0 · May 2026

This Cookie Policy describes the cookies and similar technologies used by AP Interactive Solutions S.L in its customer panel, their purpose, and how you can manage them. It complies with the General Data Protection Regulation (GDPR, EU Regulation 2016/679) and with article 22.2 of Spanish Law 34/2002 (LSSI-CE).

1. What cookies are

A cookie is a small text file that the browser stores when visiting a website. It allows the site to remember your session, your preferences, or specific interactions. In this policy the term "cookies" is used broadly and includes similar technologies such as the browser's localStorage.

  • CSRF token: hidden field in forms to prevent Cross-Site Request Forgery. Not technically a cookie, but documented here for transparency.

3. Interface preferences

Stored in the browser's localStorage (not transmitted to the server). They improve your experience by remembering your presentation choices. Legal basis: legitimate interest (art. 6.1.f GDPR) in providing a consistent interface.

  • _locale: selected language (en / es). Indefinite.
  • svc_view, svc_filter_type, svc_filter_status: saved view and filters on the services page. Indefinite.

4. Affiliate cookies (require consent)

If you arrive via an affiliate link (URL with the ?ref=CODE parameter), a cookie is set to attribute the commission to the affiliate if you sign up and contract a service.

  • _ref: referring affiliate code. Expiry: 30 days. Legal basis: consent (art. 6.1.a GDPR). Does not identify you personally.

This cookie is only set when you arrive at the site through a link containing the ?ref= parameter. If you never use an affiliate link, it is not set.

5. Cookies we do NOT use

AP Interactive Solutions S.L does not use marketing cookies, retargeting, third-party analytics (Google Analytics, Hotjar, etc.), social network buttons (Facebook, Twitter, etc.) or behavioural advertising. We do not share data with third parties for advertising purposes.

  • Firefox: Preferences → Privacy & Security → Cookies and Site Data.
  • Safari: Preferences → Privacy → Manage Website Data.
  • Edge: Settings → Cookies and site permissions → Cookies and site data.

If you disable strictly necessary cookies (session, CSRF) you will not be able to log in to the panel. If you disable preference cookies, your theme, language, or view choices will not be remembered between visits.

7. Validity and updates

This policy may be updated to reflect technical or legal changes. Revised versions will be published on this page with their date. Substantial changes will be notified by email to registered users.
